Terms and Conditions
ARISEZA operates under The 4th Musketeer NPC (Also '4MZA') and are used interchangeably as per below.

Registrations
​
By registering, the participant expressly agrees to these general terms and conditions.
​
The minimum age for participation in a weekend is 18 years.
​
The 4th Musketeer has the right to refuse the registration of participants.
​
A minimum number of participants applies for a weekend. The 4th Musketeer reserves the right to cancel the weekend if there are too few registrations. If this is the case, you will be informed no later than 1 month before departure. The paid registration fee will be refunded.
​
Suppose the participant has registered for a weekend for which the participant must book a flight ticket. In that case, the participant may not book a ticket until the 4th Musketeer has indicated whether the weekend will go ahead. Naturally, the aim is to report whether the weekend will take place as quickly as possible. The 4th Musketeer cannot be held liable for the costs of a flight ticket in the event of cancellation if a participant has booked the ticket too early.

In the event of force majeure, the 4th Musketeer has the right to cancel the weekend or to adjust it before or during the weekend without the 4th Musketeer being held liable for any damage. Force majeure occurs when abnormal and unforeseen circumstances arise that are independent of the will of the person invoking them and the consequences of which cannot be avoided, despite all precautions. This includes war, natural disasters, political unrest, general scarcity, strikes, epidemics, states of emergency or similar situations. In this case, there will be no refund of the registration fee.

In some cases, allergies and dietary requirements can be considered, after prior notification to the 4th Musketeer. However, full implementation cannot be guaranteed, and special diets will not be accommodated unless medically necessary, Any additional costs will be borne by the participant. A separate invoice will be sent for this.
​
Participation entails additional costs for the participant that are at the participant's own expense, such as the costs for transport to the starting location of the weekend, the necessary equipment, a visa, and any necessary vaccinations (if required).
​
PAYMENT AND CANCELLATION
​
Cancellations are handled through the ARISEZA office. Please also contact the ARISEZA office if you are unfortunately no longer able to participate in the activity you have booked. Verbal promises about cancellations are not valid without written confirmation, for example via email. In case of cancellation, the minimum cancellation costs are R500 per registration.

If you cancel within one month before the start of the event, the cancellation costs are 100% of the registration fee.

Media
​
Media images are made during an event. These images, in which the participant may appear, can be used for promotional purposes. The participant does not receive any compensation for this.
​
Photos and films that can be taken during the weekend are primarily intended to be shared with the participants of that weekend. Secondary, images can be used for promotional purposes (online).
The 4th Musketeer may record every participant in the Activity during and at any time on videotape, audiotape, or photograph, and may use the applicant’s name, voice, or testimonial without restriction for the future promotional purpose of the 4th Musketeer unless stated otherwise in writing.

If images of you are not allowed to appear online or if you subsequently see published images in which you appear and do not wish to see them published, please let us know as soon as possible.
​
An Event
​
If the participant causes such a nuisance that it makes or could make the implementation of the weekend significantly more difficult or endangers the safety of himself or others or deals with nature and the environment in an irresponsible manner, the participant's (further) participation in the weekend will be excluded. All resulting additional costs will be borne by the excluded participant.
​
If the participant deviates from the recommended route or the recommended time or travel schedule and therefore must incur additional costs, these costs will be borne by the participant.
​
Participants are not permitted to smoke and/or use narcotics during the weekend. Alcoholic drinks are only permitted if they are made available by the 4th Musketeer.
​
Participants are obliged to bring all resources and materials prescribed in the packing list drawn up for the weekend. The participant is responsible for providing materials of good quality. It is not permitted to bring food and drinks other than the prescribed amount of drinking water.
​
It is not permitted to take and/or use a watch, telephone, photo, and film equipment, other than two charged telephones per team which can be stored in an emergency kit issued for this purpose. In an emergency, one of these telephones can be used according to the instructions provided.
​
The participant is obliged to use the material made available in a manner for which it is intended by virtue of its nature and the agreement. The participant must report any defects upon receipt of the material and have them recorded. The participant may not make any changes to the material or allow it to be used by third parties without permission from the 4th Musketeer. The participant will inform the 4th Musketeer as soon as possible, but no later than the end of the weekend, of any damage or loss of materials. The participant will hand over the material made available to a representative of the 4th Musketeer at the previously agreed location at the end of the weekend, in the same condition as the participant received it and as clean as possible. If necessary, the 4th Musketeer is entitled to charge the participant additional costs for cleaning, searches, transport and storage of materials, missing person reports and the like.
​
The 4th Musketeer will take at least one first aider with him during the weekend. This first aider is authorised to decide during a weekend to terminate a participant's participation if, in the opinion of the first aider, continuation is no longer justified.
​
If a participant has a medical indication, the 4th Musketeer must be informed of this before the start of the weekend.
​
The 4th Musketeer can decide to set time limits and remove participants from a weekend if these limits are unmet.
​
Participants must inform a person designated by the project leader if they unexpectedly become lost. Participants cannot hold the 4th Musketeer liable for the fact that they got lost.
​
The 4th Musketeer can decide to adjust the route, shorten it or cancel a weekend entirely if the (safety) situation makes this necessary, in the opinion of the 4th Musketeer.
​
The 4th Musketeer also reserves the right to change start and/or end times.
​
Participants cannot claim compensation or reimbursement of the registration fee in the event of a decision by the organisation as referred to in the previous two paragraphs of this article.
The participant must inform himself well in advance about the activities, dangers, and risks.
​
Insurance and Medical
​
The participant must be adequately insured against all damage caused by him to others and/or the property of others.
​
The participant must have personal health insurance for providing medical services, which will provide coverage for the participant during the duration of said Activity. This coverage must ensure the participant FULLY during the duration of said Activity. If the participant is travelling internationally, the participant's health insurance must include FULL coverage in the foreign countries where they will travel, with no territorial limitations.
​
By accepting these Terms and Conditions the participant authorises the 4th Musketeer and its Representatives, if present, to provide the participant, through medical personnel of their choice, customary medical assistance, transportation, and emergency medical services should the participant require such assistance, transportation, or services as a result of injury or damage related to their participation in the Activity. This consent is given in advance of any specific diagnosis, treatment, surgery, or medications, and is given to provide authorisation and specific consent for medical/dental treatment and care on behalf of the participant.
This consent does not impose a duty upon the 4th Musketeer or its Representatives to provide such assistance, transportation, or services.

The ARISEZA team recommends an up-to-date tetanus shot and that all other immunizations are up to date.
​
The 4th Musketeer provides no health plan, and all medical expenses are the participant's responsibility.
​
Liability​
​
Participation in a weekend is always at the participant's own risk and is voluntary.
​
The 4th Musketeer accepts no liability for any direct or indirect damage that may arise or has arisen before, during or after participation in an event. This also applies in the event of cancellation or rescheduling of a weekend, as well as accidents, theft, or any damage whatsoever.
​
The 4th Musketeer is not liable for damage caused by, related to, or arising from your inadequate fitness and/or health, overestimation of your capabilities or conscious disregard of instructions.
​
By accepting the Terms and conditions the participant releases The 4th Musketeer and its Representatives from any and all liability and waives any and all claims for liability, injury, loss, damage, or expense, including attorneys' fees, in any way connected with the participant's participation in the Activity, whether or not caused in whole or in part by the negligence or other misconduct of the 4th Musketeer or its Representatives (a "Claim").

Indemnification and Risk
​
By accepting these terms and conditions the participant agrees to indemnify and to hold harmless the 4th Musketeer and its Representatives from any Claim, or any expense, including attorneys' fees. (including the cost of defending any Claim they might make, or that might be made on their behalf, that is released or waived hereby), in any way connected with a Claim.

The participant assumes all risks, known and unknown, foreseeable, and unforeseeable, in any way connected with their participation in the Activity. The participant accepts personal responsibility for any liability, injury, loss, or damage in any way connected with their participation in the Activity.
​
The participant understands the Activity may involve risk of injury and loss, both to person and to property. They also understand that the risk of injury may include the possibility of permanent disability and death. The participant understands that this Waiver, Release of Liability, Indemnification, and Consent to Medical Attention is intended to address all of the risks of any kind associated with their participation in any aspect of the Activity, or with the time they are involved in the Activity, including, particularly, such risks created by actions, inactions,
carelessness, or negligence on the part of The 4th Musketeer and/or its officers, pastors, employees,
agents, volunteers, successors, or assigns (collectively The 4th Musketeer "Representatives"), including, but not limited to, risks created by the following:

The use and condition of various modes of transportation, premises, facilities, and equipment.

The lack of, or inadequacy of policies, rules, or regulations for the Activity.

The failure of the 4th Musketeer or its Representatives to foresee or to protect me from actions, inactions, or negligence of any person, or the recklessness, intentional, or criminal misconduct of persons other than those affiliated with the 4th Musketeer.

The inadequacy or unavailability of medical facilities or treatment; or
-
The lack of, or inadequacy of supervision by the 4th Musketeer or its Representatives.

Applicable Law
​
Because The 4th Musketeer is in South Africa, and to provide certainty in the law to be applied in the construction of this instrument, this instrument shall be governed, construed, and enforced by the law of South Africa.
​
The participant assumes all risks, known and unknown, foreseeable, and unforeseeable, in any way connected with their participation in the Activity. The participant accepts personal responsibility for any liability, injury, loss, or damage in any way connected with their participation in the Activity.
​
Binding Effect. This instrument shall be binding upon the participant's relatives, personal representatives, heirs, beneficiaries, next of kin, and assigns and shall inure to the benefit of the 4th Musketeer and its Representatives.
​
Severability. If any provision (or portion of any provision) of this instrument is held to be invalid or unenforceable, that provision shall be enforceable in part to the fullest extent permitted by law, and such invalidity or unenforceability shall not otherwise affect any other provision of this instrument.
